The legal requirement: RD 8/2019
Since March 2019, Royal Decree-Law 8/2019 requires all companies in Spain to track the working hours of their employees. It does not matter the size of the company or the industry: if you have employees, you are legally obligated to keep a daily time record. The regulation amended Article 34 of the Workers’ Statute and leaves no room for interpretation.
The penalties are real
Failing to comply with time tracking requirements is considered a serious labor infraction. Fines range from 751 to 7,500 euros per infraction at the standard level, but can reach up to 187,515 euros in the most severe or repeat cases. The Labor Inspectorate has intensified its enforcement campaigns and penalties are being applied effectively.
What exactly does the law require?
The regulation is clear about its minimum requirements:
- Daily record of the start and end time of each worker’s shift.
- Retention of records for a minimum of 4 years.
- Immediate availability for the Labor Inspectorate, employee representatives, and the workers themselves.
